  2. In the event of a conflict of terms, these terms of sale shall prevail to the extent of any inconsistency.

  3. The parties to this Agreement are You and Vyne Australia.

  4. Who is Who in the Zoo:

    1. You, the purchaser of the experience;

    2. We, Vyne Australia.

    3. Vendors on the platform, the provider of the experience;

  5. Vyne operates as a marketplace for Vendors to sell Experiences through Our website. Any experience you purchase from the Vendors on our website creates  contract between you and the Vendor. We not accept any responsibility for breach of contract or negligence by them.

  6. The Services being provided by Vyne Australia to You:

    1. Includes:

      1. Access to a platform to view and purchase experiences from our Vendors; and

      2. Facility to pay for the Experience;

    2. Does NOT include:

      1. Delivering the Experience to You; and

      2. Your health and safety in delivering the Experience.

  7. The Vendor is responsible for:

    1. Delivering the Experience to You; 

    2. Your safety and wellbeing as a part of the Experience.

  8. How to place an order:

    1. Browse our site online and add services to your cart by clicking on the ‘Add to Cart” button.

    2. To complete your order, click on View Cart and then proceed to “Secure Checkout” once you have selected the services you would like. 

    3. Once you are ready to purchase, click “Buy Now”. 

    4. We reserve the right to review and decide whether or not to accept the order for any reason including but not limited to:

        1. We suspect that you will on sell our service to third parties:

        2. If we suspect that fraud applies to your Order;

        3. The was a mistake by Us such as wrongly stated prices.

    5. We will process payment through your nominated method.

    6. Once accepted by Us, we will send you a confirmation of acceptance.

    7. Until we send you a confirmation of acceptance of order, you have the right to seek a refund by your original payment method, less p

  9. Payment process:

    1. You must pay for the Order in full at the time of ordering by one of the payment methods we accept on our website. The payment method must have sufficient funds, credit or other payment facilities to cover the purchase.

    2. We are not responsible for the decisions of payment providers to allow you to use their service, or provide any warranties or assurances about them. 

    3. By placing an order, you authorise us to conduct credit and security checks on you and your cards. This may involve transmitting your personal information to third parties including your credit card information.

  10. Cancellation

    1.  We reserve the right to terminate any order if the experience is not available. In this situation, we will notify you and provide a refund.

    2. Should you need to cancel a booking, we require a 48 hour minimum notice period. We will then issue you a full refund.
  11. If you are ordering for a Group, you warrant that all persons registered to participate in the activity are over the age of 18.

  12. It is a breach of these terms to:

    1. Resell the ticket to a third party; or

    2. Behave in a rude, abusive, drunk or disorderly way to our staff, contractors or our Vendors and their team or anyone at the venue where the event is to take place.
       

  13. The Vendor may refuse to serve persons for any reason including the responsible liquor laws in the relevant state or territory.

  14. Limitation of liability:

    1. To the extent allowed by law, our liability is capped at either:

      1. A refund ; or

      2. A replacement.

    2. Vyne reserves the right to choose whether to issue a refund or replacement.
